This Personal Data Notice ("Notice") explains how Dominic Gan & Company, Advocates & Solicitors, a law firm based in Kuala Lumpur, Malaysia with its place of legal practice at Chamber A-13-7, Menara Atlas, Plaza Pantai, 5 Jalan 4/83A, Off Jalan Pantai Baru, 59200 Kuala Lumpur (hereinafter referred to as "DG") may uses your Personal Data.
By appointing DG to provide legal services or by interacting with DG either at our events, office, conferences, seminars or otherwise, or by using the DG blogger website at www.dominicgan.blogspot.com ("Website"), you consent to the processing of your Personal Data by DG and all persons involved in the provision of services by DG. Kindly take notice that DG shall have the right to modify, update or amend the terms of this Notice at any time by placing the updated Notice on the Website. By continuing to communicate with DG or by continuing to use DG's services following the modifications, updates or amendments to this Notice shall signify your full acceptance and/or consent of such modifications, updates or amendments.
Collection of Personal Data
1. "Personal Data" means information about you which you have provided to DG, e.g. your name, address, telephone number, national identity number and/or passport number, email address, your personal preferences, particulars of your family members, bank account information and any other information which may identify you or your family members that has been or may be collected, stored, used and processed by DG throughout the appointment/ engagement.
2 Additionally, DG may also collect your Personal Data from a variety of sources, including without limitation at any events, conferences or talks organised or sponsored by DG and/or from the cookies used on the Website and/or any other information available from data collectors such as CTOS, CCRIS, bankruptcy search and winding up search.
3. The provision of your Personal Data is voluntary. However, if you do not provide your Personal Data, DG may not be able to (a) communicate with you; (b) provide you the legal services you require, (c) fulfill your instructions.
Purposes of Processing
4. DG may use and process your Personal Data for the purposes relating to the legal services you have requested and for the business activities of DG which shall be as follows:-
(a) to communicate with you;
(b) to respond to questions, comments and instructions;
(c) for internal administrative purposes, e.g. opening a file;
(d) to provide information to regulatory, government and judicial authorities;
(e) for DG to comply with its obligations under the law; and
(f) you agree and consent to DG using and processing your Personal Data in the manner as explained in this Notice.
Other Purposes
5. DG may also use and process your data for other purposes such as:-
(a) to send you materials e.g. legal market updates;
(b) to distribute information or details of events, seminars, conferences and talks which may of interest to you;
(c) to send as potential referees to legal publications and journals.
If you do not consent to DG processing your Personal Data for the purposes listed in Clause 5 hereof, kindly notify DG using the contact details stated in Clause 8 below.
Transfer of Personal Data
6. As DG's information technology storage facilities and servers may be located in other jurisdictions, your Personal Data may be transferred to, stored, used and processed in a jurisdiction other than Malaysia. Additionally, your Personal Data may be transferred out of Malaysia for the purposes as described in Clause 5(c) hereof where such legal publications and journals are located outside of Malaysia. You understand and consent to the transfer of your Personal Data out of Malaysia as described herein.
Disclosure to Third Party
7. DG may engage other companies, firms, service providers or individuals to perform functions on behalf of DG, and consequently may provide access or disclose to your Personal Data to the third party including but without limitation:-
(a) information technology service providers;
(b) data entry service providers;
(c) storage facility providers;
(d) banks and financial institutions;
(e) insurance providers:
(f) any professional advisors and external auditors;
(g) regulatory, government and judicial authorities.
Access & Correction Requests and Further Inquiries
8. Subject to any exceptions under applicable laws, you may at any time hereafter request for access to, or for correction or rectification of your Personal Data or limit the processing of your Personal Data, or seek further information from DG by contacting:-
